This notice explains how PostPay collects, uses, discloses and protects personal data in connection with the Pascara-i financing programme, in accordance with the Personal Data Protection Act 2010.

This notice applies specifically to individuals who apply for, use or interact with the Pascara-i programme.

Scope of this Notice

This Privacy Notice applies specifically to the Pascara-i financing programme. It does not constitute a general privacy notice for all PostPay products, services or corporate activities.

Please be advised that Postpay Technology Sdn. Bhd., (hereinafter referred to as "PPTSB", "the Company", "us", "our" or "we") is giving you this Personal Data Protection & Privacy Notice (hereinafter referred to as "Notice") as an exercise to comply with the Personal Data Protection Act 2010.

As part of PPTSB’s day to day business, we value your privacy and strive to protect your personal information in compliance with the laws of Malaysia. We are committed to safeguard and respect the privacy of your Personal Data for the Purposes and to conduct our business and to deliver the service you expect.

We appreciate your support for our services and value our relationship with you. We would like to continue communicating for further information on our products, services, promotions and matters relating to the Purposes above, which we may consider to be interesting to you from time to time.

1.0 Collection and Processing

This Notice serves to inform you that your Personal Data is being Processed by or on behalf of PPTSB and you hereby give your consent to the Processing of your Personal Data.

2.0 Types of Personal Data

The types of personal data we receive from you including but not limited to ("Personal Data"):

  1. Personal information to establish your identity and background;
  2. Personal information to establish your financial standing;
  3. Personal information to establish your location;
  4. Personal information that you provide when you apply for any of our products and services;
  5. Personal information that may be required and you provide for risk/fraud management;
  6. Information relating to your employment status and details;
  7. Information relating to your payroll/salary, such as bonus, incentive, benefit, allowance, or commission, bank account details, or income tax file numbers;
  8. Sensitive information relating to your religious belief, physical or mental health condition or medical information;
  9. Sensitive information relating to any past or alleged breaches of offences or convictions under any law;
  10. Any other information supplied by you that can indirectly or directly identify you; and/or
  11. Any other information which we deem necessary or appropriate for the Purposes.

To the extent that you disclose to us any personal information and/or personal data of another individual, we shall assume, without independent verification, that you have obtained such individual’s consent for the disclosure of such information, as well as the Processing of the same in accordance with the terms of this Notice.

3.0 Sources of Personal Data

Your Personal Data is being or is to be collected:

  1. from your Malaysian Identification Card and/or Passport;
  2. when you fill in any forms, letters, agreements and/or contracts for our licenses, products and/or services;
  3. from you directly when you submit your Personal Data to us for any of the Purposes;
  4. from all other communication between you and us on any subsequent occasion;
  5. from any other forms, cards and documents through which we collect information from you;
  6. from any events conducted by PPTSB;
  7. from any third parties (including credit reference bodies, regulatory and law enforcement authorities);
  8. from all other information that you may provide us from time to time; and
  9. from any other resources that we deem appropriate from time to time.

4.0 The Use of Personal Data

The use of the Personal Data is for the following primary purposes ("Purposes"):

  1. To administer, consider or process your request or application for the products or services provided by us;
  2. To provide or facilitate the provision of services or products as requested by you, including facilitating or processing payments or transactions;
  3. To conduct debt collection or recovery from you and/or persons whom you have provided us with the information;
  4. To perform verification and authenticity of the Personal Data provided to us, including your identity;
  5. Prevention, prosecution, investigations of fraud or other illegal activity or potential illegal activity;
  6. Requirements of a civil or criminal legal process and/or as required by law or regulation;
  7. To disclose to vendors, suppliers, counter parties, persons who provide a service to PPTSB or are acting as PPTSB’s agents;
  8. To compare information/data for accuracy, and verify it with third parties;
  9. Marketing and promotions of products and services of PPTSB;
  10. Communication with you and/or your employer of or in relation to our services or products;
  11. General administration;
  12. Manage and maintain your account(s) and facility(ies) with us;
  13. Respond to your enquiries and complaints and to generally resolve disputes;
  14. Update, consolidate and improve the accuracy of our records;
  15. Conduct study, assessment, analysis, research and survey;
  16. Meet the disclosure requirements of any law binding on us;
  17. For audit, compliance and risk management purposes; and
  18. Any other purpose that we deem necessary and/or as required or permitted by any law, regulations or relevant regulatory authorities.

5.0 Disclosure

5.1 Your Personal Data will be kept confidential but you consent and authorise us to provide or share your Personal Data to the following class of users, whether inside or outside Malaysia:

  1. Persons/Organisations required under law or in response to government requests;
  2. Related, subsidiaries, holdings of PPTSB, including future entities of PPTSB;
  3. Government agencies, statutory authorities, enforcement agencies under law;
  4. Financial institutions or related institutions for purpose of facilitating or processing payments or transactions;
  5. Auditors, accountants, lawyers of PPTSB;
  6. Contractors, sub-contractors, affiliates, agents, representatives, consultants of PPTSB;
  7. Third party service/product providers that are deemed necessary or appropriate for the Purposes;
  8. Persons under a duty of confidentiality to PPTSB;
  9. Any other purpose that we deem necessary and/or as required or permitted by any law, regulations or relevant regulatory authorities.

5.2 Personal Data shared will be for the Purposes, or purposes not stated but directly related to the Purposes of collection.

5.3 We take reasonable steps to ensure that the third parties with whom we are sharing your Personal Data also have appropriate privacy and confidentiality obligations.

6.0 Marketing & Promotional Activities

6.1 We may use your Personal Data to provide you with information about our and third party products and/or services, which may be related to your interests, unless requested otherwise by you.

6.2 We may, in some circumstances, disclose your Personal Data to preferred merchants and strategic partners, only where you have subscribed for particular products and/or services which require such disclosure, and/or where your consent has been obtained.

7.0 Transfer of Your Personal Data Outside Malaysia

7.1 It may be necessary for us to transfer your Personal Data outside Malaysia in accordance with this Notice.

7.2 We shall take necessary steps to ensure that any such partners are contractually bound not to use your Personal Data for any reason other than to provide the products and/or services they are contracted by us.

8.0 Protection of Personal Data

8.1 Some of our functions and activities are outsourced to service providers which include data Processing services, mailing services, or data storage based in Malaysia and outside Malaysia.

8.2 Administrative and physical security measures will be used to protect your Personal Data. We take reasonable steps to securely destroy your Personal Data when we no longer require it.

8.3 The following practices are adopted in relation to online Processing of Personal Data:

  1. On-Line Security – Strict standards of security and confidentiality to protect any information provided on-line.
  2. On-Line Correction – Personal Data provided and submitted through online may not be facilitated to be corrected, updated or deleted on-line.

8.4 Our service providers and staff are bound by contractual duty to keep confidential any data they come into contact with against unauthorised or accidental access, processing, erasure, loss, use and retention.

9.0 Retention of Personal Data

9.1 Your Personal Data will be stored for only the period as necessary to fulfil the Purposes or as required by law or regulation, after which it will be destroyed, anonymised or permanently deleted. Reasons to further store your Personal Data include:

  1. to satisfy legal, regulatory or accounting requirements; and
  2. to protect the interest of the Company.

10.0 Consequences of Failing to Supply Personal Data

The collection of your Personal Data by us may be mandatory or voluntary in nature depending on the Purposes for which your Personal Data is collected. Where you fail or choose not to provide us with such data, or do not consent to this Notice, we will not be able to provide you with the products and/or services or otherwise deal with you.

11.0 Access, Correction & Inquiry

This Notice may be revised from time to time. We will post notice of any amendment on this Notice on the website and/or by such other means of communication deemed suitable by PPTSB.

12.0 Conflict

In the event of inconsistencies or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.
